POLL: Would You Charge A Cop?

on friday may 28th of 2009 i was driving home from a friends house at about 11:30 at night. i was about 4 blocks from my house, when all the sudden two cop cars started to follow me, they turned on the light sna sirens, so i pulled over, scared and confused as to what was going on. they told me to step out of the car and put the hand cuffs on me(they never read me my rights) they stated that i was driving in and out of lanes and it seemed that i was intoxicated. i admitted to having a beer that night, but i was deffenitly not drunk and 100% capable of driving, they did a breath test on me and i did not come over the limit. the officer than put me in the back of the police car and searched my car, he looked in my purse and even turned on my camera and looked at my pictures and videos. he than called my father to come and pick me up to take me home and said my liscence will be suspended for 30 days. he never gave me a ticket(pink slip) or anything. after the 30 days was finished i called my local station, because i was not sure what steps to take, the officer than told me to go to the ministry of transportation and pay a 150$ fine, he than said that it showed on his record that it was only suspended for 3 days. so i went down to the ministry of transportation to get it back, and they told me there was nothing in their file that said my liscence was suspended. and she reccomended i go to the police station and see what going on(she said the officer that took my liscence should have given me a ticket) so i went down to the station and asked what was going on. the officer said he has no clue and that i would have to speak to the man that took my liscense and he will not be in until friday. during the 30 days i was waiting for my liscense, me and a couple of friends were hanging out at the beach drinking wine coolers and beer. the police than came( same officer that took my liscence) he threw me on the floor harshly, where i almsot smashed my head on a rock and yelled in my face, he than roughly picked me up and told me not to move, he than called my mother and told her i was causing trouble. and he said to all my friends don't hang out with this girl, shes trouble i arrested her awhile ago for drinking and driving. what can i do in this situation. i live in ontario not in the states. can he be charged for looking at my camera and handeling me roughly? can he be charged for not giving me a ticket. oh today i lost my job as well, because i was in the station waiting an hour to talk to someone. please help!!

  1. you're leaving out imporant details.....like how old you are. Also, you do not have to have your rights read to you upon arrest. In spite of what you see on TV (I'm pretty sure that is the same in Canada) It seems like the officer probably did what was necessary, as I doubt you were as innocent and cooperative as you are trying to sound. However, even if you're being 100% accurate, it's generally pretty pathetic to think of the police department as an ATM. So to answer your poll: No, definitely not. Of course, I wouldn't put myself in those situations either. If it makes you feel better, file a complaint with the department....even though I doubt it's warranted.
  2. File a formal complaint at the police station. He probably won't face any criminal or legal charges but your complaint will definitely go on his permanent record, which will follow him for years. Good luck!
  3. Um... wow. He is not allowed to toss you on the floor if you're not actively doing anything to hurt anyone or resisting orders. And I'm pretty certain he's not supposed to go through your pictures and videos, either. As was said before, you left out the important detail of how old you are, but that doesn't make too much difference to the assault and the snooping. It sounds like this guy is a complete asshole and gets a kick out of bullying people with a badge and uniform. I would compile all your complaints in advance, and report it to the police department. Try not to sound like you're just annoyed or being whiny and going "it's not fair!" Just be calm, rational, and get your point across. Hopefully this guy's superiors will give him a dressing-down.
